DENIC to release One and Two Letter Domain Names as of October 23rd, 2009

Following an order of a German court, forcing DENIC, the registry operator of the .DE ccTLD to register the two letter domain vw.de, DENIC has now announced that they will open up registration for almost all formerly restricted domains on October 23rd as of 9am CET. The registry says that they have made this decision after talking to other registries that did not have the same restrictions as well as after conducting a number of technical tests.The domains will be registered on a first come first served basis and will be available through DENIC accredited registrars.

The new rules are:

  • One- and two-digit domains as well as domain names composed exclusively of numerals can now be registered.
  • Domains identical with combinations of letters that are used for motor-vehicle number plates or for TLDs are released for registration.
  • A domain may be comprised of the digits 0-9, hyphens, the letters a-z of the Latin alphabet and the other letters listed in the currently valid annex to the Domain Guidelines.
  • A domain must neither begin nor end with a hyphen. Neither must it have hyphens as both its third and fourth characters.
  • The minimum length of a domain is one character.
  • The maximum length of a domain is 63 characters (referred to the ACE-encoded form of the domain) – without .de respectively.

Considering that these modified rules also allow for registration of a domain that equals an existing TLD, this should also mean that DENIC will remove the administrative lock that it had recently placed on domains that matched on of the TLDs introduced over the last few years, such as travel.de, biz.de, info.de and museum.de The lock was basically prohibiting owner changes for any of those domains

I have yet to see many of the registrars announce that they will take pre-registrations. Also you may want to put in your orders with as many registrars as possible in order to increase your chances…

Here are the two is the one that announced that they will take pre-registrations, but I’m still waiting for more well known players (i.e. Domainers.de, EuroDNS, OpenSRS, Strato) to do the same:

Anyone got linkage to the court order? I’m interested to see why the court would do such a thing. My German is très rouillé ;) but I’m not seeing anything here as yet: http://www.bundesverfassungsgericht.de/en/decisions.html

Bit more reading into it shows that these regs go a) through a dedicated system and b) a registrar can submit 4 registrations per minute only.

Obviously you also need some appetite for risk if you wanted to go for any 2 letter .de domains. This opening of the namespace stems from the lawsuit by Volkswagen – and they sure as hell will go after anyone who manages to register vw.de before them. You’d then have to defend the name in a German court…

@Sedo: Your link does not work – it says the auktion has ended. Interesting that InternetX is taking orders directly, I would have expected them to partner with you.

@Anonymous Hero: Planning on having fun with German court orders, lol? Heise has a great (German) summary here. Basically the court ordered DENIC to register “vw.de” (requires registration), since it was discriminating against Volkswagen according to the court’s findings (based on competition laws for businesses). DENIC fought this order, but in the end the court decided against their injunction.

I just got word from Sedo that the link is correct and will be live within an hour. They also published a (German language) press release on this topic. The press release mentions another link on the DENIC website with further information on the court order.

In theory it shouldn´t be allowed for DENIC or any registrar to assign a domain to a private corporation. What if someone else also had the right to vw.de? For .asia and other domain launches it was first come first served starting out with a queue for special rights (trademark, company name), which is a fair practice.

@Christoph: DENIC was ordered by a court to register the name for Volkswagen (which is a public corporation).

This is not a new TLD launch, but a change of rules, just similar to the one by .BIZ recently.

@IdiotDomainer: The .DE registry is organized as a sort of a collective – it is owned by the registrars and does not make a profit itself. Any profit that is earned is paid back to the registrars at the end of the year. I guess this would increase their profit too much and potentially lower give the registrars too much of a refund at the end of the year. In addition it would threaten DENIC’s neutral position when it comes to trademarks etc.

Thanks for the link Frank. It’s always good to know why courts have forced a change.

They have vw.com, vw.co.uk, vw.nl and vw.de, so vw.de makes a set :)

But not all of them because DENIC only gave a week’s warning and not all Registrars are in a position to do the work required to hook into the special process they’re running at the start.

Tucows/Opensrs aren’t participating, I believe.
