Robert Arkow keeps – Wins UDRP Ruling

by Chad Kettner in Categories: Legal Issues

Tags: , , , ,

In 2006, Robert Arkow created so people from Southern California would have a place to discuss their local commuter railway’s service. Unfortunately, after seeing complaints about fare increases and customer service issues, the Southern California Regional Rail Authority (SCRRA) became upset and tried to strip Arkow of his domain. After a lengthy process, Arkow won!

The UDRP decision-maker determined that Arkow had a legitimate interest in using the domain name as a place to comment and criticize on MetroLink’s service. It also decided that since Arkow was not a competitor of the SCRRA and ran a completely non-commercial site, there was no way he registered it in bad faith. It concluded that “something more than criticism is required to establish illegitimacy and bad-faith for purposes of the [UDRP].”
